DJJ calendar


The academic calendar for teachers in the Division of Juvenile Justice (DJJ) was signed by Unit 3 negotiators on Jan. 25. The academic year starts Aug. 1, 2011, and ends July 6, 2012. The beginning of the 2012-13 academic year will be discussed over the following months and be announced no later than Nov. 15, 2011. Until discussions are held, it will remain unknown whether July 30-31, 2012, will be work days (this is reflected on the calendar).

Note: No Personal Leave Program 2010 (PLP) blackout days were proposed by the Education Service Branch of DJJ. The management team reaffirmed its commitment that DJJ teachers should be afforded maximum discretion in the use of furlough and PLP 2010 leave in consideration for pay cuts experienced as a result of both programs.
Office of Correctional Education

The Office of Correctional Education (OCE) signed six academic calendars for use in the adult division of the Department of Corrections and Rehabilitation on Feb. 3. OCE proposed Faculty Days Off (FDO) acceptable to the majority of members, with only a minor adjustment needed. At the suggestion of Local 1000, we identified Jan. 2, 2012, as FDO because it coincides with the observed New Year's Day holiday.

Blackout days changed

Unlike DJJ, OCE proposed several weeks of "MOU blackout days" preventing teachers from using PLP 2010 leave in conjunction with two-week breaks during summer and winter, and at Thanksgiving. This restriction of discretionary PLP 2010 leave was unacceptable to the bargaining team and all teachers reviewing the proposed calendars. Management argued flexibility was needed to schedule important training during all parts of the year. OCE representatives failed to identify a valid example of such training. WASC activities and compliance reviews were mentioned, as was NCCER training--which is only for some of the vocational instructors. Several proposals were passed from both sides and a compromise was reached; calendars were signed. The new "blackout days" are separated from FDO breaks and are now associated with Wednesday staff development days at the beginning of August, September, November, December, February, March, May and June. The Unit 3 bargaining team agreed to this decision but expressed grave doubt that OCE or local managers would be able to schedule all important activities during these days.

All calendars will include a cover memo in which local administrators are directed to schedule important activities such as WASC meetings, compliance reviews, graduations and staff development trainings on these days whenever possible. OCE committed to schedule its activities during these blocks of time whenever possible. The cover memo also describes the use of sick leave on these days.

Exception

In the case of illness or other valid use of sick leave, your principal can authorize use of Personal Leave Program 2010 (PLP) time in lieu of sick leave. This may prevent employees from being docked if they have no remaining sick leave. It also promotes the use of PLP 2010 leave in lieu of sick leave and helps conserve sick leave for future use.

Reminder

On days when PLP-2010 is not authorized, all other forms of leave remain valid, including sick leave, Personal Necessity Leave (PNL), Professional Development Days (PDD), PLP (Personal Leave Program) and Voluntary Personal Leave Program (VPLP). Vacation, annual leave, holiday credit, informal leave and all other forms of leave can be used in accordance with applicable policies and contract language.

Remember, teachers in DJJ and OCE earn 6.78 hours of PLP 2010 leave per month over twelve months, providing a total of 10.18 days. You have until June 30, 2013, to use this leave credit or it will be lost. Other special rights and restrictions are described in the DJJ and OCE addenda to the PLP section of the new Memorandum of Understanding (MOU). All leave credits, including PLP 2010 and furlough, are used in whole day increments. If you have less than 8 hours of either leave on the books, you can supplement enough leave of another type in order to use the remaining leave. See the MOU for details.

Note: Teacher preparation time

Under Article 21.14.3 of our contract, teachers finding one day of "quarter break" insufficient to meet the paperwork required under the new academic models should request, in writing, additional release time. If reasonable time is denied a grievance should be filed.

New academic models are under review and we are hopeful that pressure brought at the bargaining table will pay off in the revision of the models. Managers claiming they were prevented by the academic calendar from authorizing additional prep time at the end of a quarter should be challenged. A statement of this kind could result in an unfair labor practice charge.
