Final ruling: back pay, plus interest for our SCIF workers

Judge Charlotte Woolard of the San Francisco Superior Court issued a final ruling Thursday morning declaring that Local 1000-represented employees of the State Compensation Insurance Fund (SCIF) are entitled to back pay – plus interest.

Woolard agreed with Local 1000 attorneys on all points. She agreed that workers are due interest for lost wages from furloughs.

Private attorneys representing the governor did not show up at Thursday's hearing to contest the issue.

Tentative ruling: back pay, plus interest for SCIF workers

Judge Charlotte Woolard of the San Francisco Superior Court issued a tentative ruling Wednesday afternoon declaring that Local 1000-represented employees of the State Compensation Insurance Fund (SCIF),  are entitled to back pay - plus interest.

In the brief tentative ruling on the San Francisco Superior Court Web site, Judge Charlotte Woolard writes:  "Back pay is appropriate to make petitioners (SCIF workers) whole." The tentative ruling also states that the employees are entitled to interest "since damages are certain by calculation."

The ruling is not final and could be modified after a hearing scheduled at 9:30 a.m., Thursday in Woolard's courtroom, Dept. 302, at the Civic Center Courthouse in San Francisco.


SCIF furloughs canceled effective immediately

A legal victory by Local 1000 in San Francisco Superior Court has ended furloughs for Local 1000- represented SCIF employees. The order - an initial and binding decision signed by Judge Charlotte Woolard - is effective immediately.

The order also prohibits the Governor and DPA from arguing the order should be stayed pending appeal. This allows the State Controller’s Office to reprogram the payroll system to full pay for SCIF workers immediately.

Judge nixes furloughs for 6,260 SCIF workers

More than 6,000 State Fund (SCIF) employees will be exempt from furloughs following a court victory by Local 1000.

San Francisco Superior Court Judge Charlotte Walter Woolard agreed with Local 1000 attorneys and on Sept. 1 declared the furloughs of SCIF employees illegal and ordered back pay plus interest for members who lost money as a result of the furloughs. Woolard is scheduled to issue her final ruling Sept. 10 and is expected to stop furloughs for SCIF employees at that time.
