My intent is to EDUCATE the member so everyone can easily understand the agreement.

Here is a brief history
According to the State, nearly all the vacancies are currently filled in DJJ.

We (U3 in CDCR-Adult) started hearing rumors about raises coming our way. Principals and Vice-Principals at various places including OCE started talking about everyone getting a 20% increase. As a matter of fact, the Department started advertising in newspapers that we were "in negotiations", when we were NOT in negotiations. This created a buzz. Many U3 members were under the impression that the "Union" was somehow holding up the progress of these increases. This impression is completely false.

We received an Official notice from the State on June 6, 2007 that stated the following:
"This is the Official Notice to the SEIU that the Department of Personnel Administration is proposing a Salary Schedule change for the Bargaining Unit 3 Teacher and Vocational Instructor classifications used in the CDCR Adult Education Program. Our proposal will suggest that the DJJ Salary Schedule be used as a model in this process."

I leave you with this information to digest, but I have also attached a complete copy of the current DJJ agreement. I would challenge everyone to read this agreement... Besides, it is a great cure for insomnia... But it is important, because it is the "model" in this process.

Salary Questions and Schedules
There will probably be nuances and cases that are not covered here. If anyone has a question that is not answered, please email Unit 3 Chair, Cindie Fonseca at goprt19@yahoo.com .  When doing this, have your salary schedule in front of you.

You will find an explanation of this language in purple. Tthe black type is the actual language. Be prepared there is some math involved with this language.


CDCR, Office of Correctional Education, Academic Teacher/Vocational Instructor Salary Schedule

* A.  A current CDCR, OCE Unit 3 eligible employee, effective August 1, 2007, shall be compensated in accordance with the DJJ/CEA Unit 3 - Salary Schedule designaged by the CDCR, OCE Superintendent and as follows:

* B. For initial placement effective August 1, 2007, no teacher will be paid below his/her current daily rate salary earned on July 31, 2007. To calculate the new daily rate, first calculate the employee's annual salary by multiplying the current monthly salary by twelve (12 months). Divide the annual salary rate by 220 (work days) and multiply the number (work day rate) by 1.054 (5.4%).
 
Current monthly salary times (x) 12 = Current Annual Salary
Current Annual Salary divided by 220 times (x) by 1.054 = Daily rate.
If the daily rate that is calculated does no match any daily rate figures on the respective salary schedule, the employee will be paid the next highest daily rate. 
 
Let's take someone who is topped out and put their earnings into this equation.
As of July 31, 2007 your monthly income is $6147 (this includes the 3.4% increase we have not yet received because the budget has not passed).
 
Take the monthly $6147 and multiply by 12 = $73,764 (Annual Salary)
 
Currently, we are paid for 261 days. This includes 248 work days and 13 paid holidays.
 
If you take the annual $73,764 and divide by 261 you get a daily rate of $282.62. This is our current daily rate of pay... for those who are topped out.
 
Now, if you take the same annual $73,764 and divide by 220 the daily rate of pay increases to $335.29.
 
You then take the $335.29 and multiply it times 1.054 and that equals $353.40.
 
The 1.054 is what we call the "vacation factor". Since the average vacation earnings of a U3 member in CDCR-Adult is 15 days of vacation. We created a decimal equivalent of 5.4% to add to the minimum "grandfathering" in salary. Vacation obviously has a value (besides the emotional one) and 5.4% is what is added to the daily rate.
 
Soooo... this means that anyone currently working for CDCR-Adult who is topped out will not receive less than $353.29 a day.

This is where ALL employees who are currently topped out will be placed in their respective counties. If you have more education than those ranges require you will be moved to that range once you have sat down with the State and provided transcripts that show that you have more education than these ranges require. For example, you work at HighDesert, this puts you in the Sacramento salary schedule. You would be placed in Range D - which requires 36 semester units beyond your BA. If you have 48 units you would be grandfathered into Range D, but then changed to Range E, once you have provided proof and then receive retroactive pay to August 1, for the Range change to E.
 
If you do not have as many college credits that are described in this column (using same example as above), you would be grandfathered in to Range D. You will not move to Range E until you complete 12 semester units that are pre-approved. When you are grandfathered into a Range, it is assumed you have that many units even if you do not. So you don't have to get 48 to move to Range E, you only need 12 to move from Range D to Range E.
 
If you are not topped out then take your current monthly and put in place of the $6147 and do the math.
 
Simply, the equation is:
Monthly salary x 12 = Annual Salary
Annual Salary / 220 = Daily Rate
Daily Rate x 1.054 = new minimum daily rate of pay*
 
*If this amount is not reflected, then you would go to the next higher box. You will be placed in the lowest range that has this amount in the column. So, if the daily rate is reflected in Ranges C, D and E - you will be placed in C.
  
(It is very important to look at the new salary schedules when identifying where you belong. In DJJ there was some confusion because people mixed the the two salary schedules.)

 
* C. The parties agree that the calculation will provide all affected employees with a starting pay rate until the terms of E. below are met.

*D. Current CDCR, OCE Unit 3 employees initially placed on the salary schedule based upon salary, establishes the individuals' qualifications for that range. All employees hired prior to August 1, 2007, who are initially placed into the salary schedule based upon salary, will move in range upon completion of twelve (12) credits through Range E for Vocational Instructors and Range F for Academic Teachers.
 
The restrictions are here for Vocational's because once you move out of Range E, you have to have a REAL Bachelor's Degree, no equivalency will be accepted. The restrictions are here for Academic's because one you move out of Range F, you have to have a REAL Master's Degree, no equivalency will be accepted.

 
*E. Affected employees shall be permitted to submit official documents by December 31, 2007, to support initial placement or advancement on the salary schedule. No documents shall be accepted from employees after December 31, 2007. Adjustments to initial placement or advancement will result in retroactive payments to the employees date of hire, but in no case prior to August 1, 2007.
 
I described this process above.
 
* F. Upon the implementation of D. above, a current CDCR, OCE Unit 3 eligible employee shall be placed on the salary schedule first by education above the Bachelor's Degree or for career-technical teachers the equivalent of a Bachelor's Degree (High School Diploma plus seven (7) years of college work and in trade work experience) and second by years of full-time credentialed teaching experience.
 
This is an important point.. You are placed by EDUCATION first. If the Range you are placed does not go beyond Step 8, you will not go beyond Step 8 until you change ranges.
 
*G. For current and new employees with less than ten (10) years of State credentialed service, outside qualifying experience ina full-time credentialed teaching position can be used to place the employee up to a maximum of Step 10.
 
So.. what this means is that if you have outside teaching experience, you can apply up to step 10. For instance, you have 5 years with the Department and 5 years outside, you will be placed at step 10. If you have 8 years with the Department and 5 years outside, you can only use 2 years from your outside teaching experience. If you have 10 with the State, you cannot bring any of your outside experience because that would place you above step 10. The combination of the two cannot exceed step 10.
 
IT IS IMPORTANT TO NOTE... PLACEMENT IS BASED ON TEACHING SERVICE WITH THE STATE.. NOT STATE SERVICE... IF YOU WORKED IN PLANT OPS AND THEN BECAME A VOCATIONAL INSTRUCTOR.. ONLY YOUR TEACHING YEARS WILL COUNT TOWARDS PLACEMENT ON THE SALARY SCHEDULE.

* H. Additional daily rate incentives may be paid for hard to fill classifications.

* I. Each step/range moving either down/across is a 3.5% increase. Steps are credentialed years of service. Range increases are attained by completing additional education credits as described on the salary schedule.
 
The steps on the DJJ salary schedule will be applied for salary placement and advancement in the following manner:
Step 1     0-12 months
Step 2     13-24 months
Step 3     25-36 months
Step 4     37-48 months
Step 5     49-60 months
Step 6     61-72 months
Step 7     73-84 months
Step 8     85-96 months
Step 9     97-108 months
Step 10   109-120 months

The employee will advance to the next step, when they start the month of service described in that respective step.
